DesignPresso Terms of Service

1. Purpose

These Terms govern your use of DesignPresso (the "Service"), an AI studio for generating and editing images, video, and audio, provided by 주식회사 리콘랩스 (RECON Labs Inc.) ("Company", "we").

2. Service Provider and Payment Processing

The service provider and your contracting party is 주식회사 리콘랩스, a company incorporated in the Republic of Korea. Payments are processed by our wholly-owned U.S. subsidiary, RECON Labs Inc., through a payment processor (e.g. Stripe); the payment descriptor on your statement may show the subsidiary's name. Regardless of who processes payment, responsibility for the Service and for refunds/consumer protection rests with the Company as service provider.

3. Accounts

An agreement is formed when you accept these Terms and the Privacy Policy, register, and we accept your registration. The Service is for users aged 14 and older. You are responsible for your account credentials and activity.

4. Credits and Subscriptions

• You may buy credits or subscribe to use paid features. Paid actions (e.g. AI generation) deduct credits per our pricing.
• Subscriptions auto-renew each billing cycle (monthly/annual). You may schedule cancellation at any time before the next charge; cancellation takes effect at the end of the current cycle.
• Complimentary credits (e.g. sign-up bonuses) are non-refundable and non-transferable.

5. Refunds

• Unused credit top-ups may be refunded within 7 days of purchase.
• Credits already consumed correspond to digital content that has been supplied and are non-refundable; only the unused balance is refundable.

6. Your Content and Rights

• You retain rights to and responsibility for content you input or upload, and you warrant it does not infringe third-party rights or violate law.
• You grant us the rights needed to store, process, and transmit your content (including to third-party AI processors) to provide and improve the Service.
• You may use generated outputs to the extent permitted by law and by our and our AI providers' policies. Legal ownership of AI outputs may be subject to applicable law; you are responsible for your use of outputs.

7. Use of Data for Research and Promotion

We may use data arising from your use of the Service — inputs, outputs, usage and configuration records, and generation success/failure and quality-evaluation records ("Usage Data") — for the following purposes:

• Research and development: improving the quality and reliability of the Service, evaluating and improving our AI generation pipeline and models, producing statistics and conducting scientific research, and developing abuse and unlawful-content detection.
• Promotion: featuring use cases and generated outputs in Service materials, our website, blog, social media channels, and conference or exhibition materials.

For research and development we use pseudonymized or anonymized data as a matter of principle, so that individuals cannot be identified. Where identifiable data must be used, we do so only with your separate consent or on another lawful basis under applicable law.

Promotional use is limited to (i) projects and outputs you have set to public and shared within the Service, and (ii) content you have separately agreed for us to feature. We do not use projects, inputs, or outputs you keep private for promotional purposes.

For such content you grant us a royalty-free, non-exclusive right to reproduce, display, and transmit it, and to edit it as needed for publication (resizing, excerpting, captioning) within the promotional purposes above. You retain your rights in the content under Section 6, and this grant ends prospectively when you make the content private, delete it, or object as described below.

You may object to research or promotional use, or withdraw a consent you previously gave, at any time by writing to support@designpresso.ai. We will stop the relevant use without undue delay and remove the content from published promotional materials, except for data already pseudonymized or anonymized such that it can no longer be traced to you and for media that cannot be recalled (e.g. printed materials), where we will act to the extent technically possible. Objecting will not disadvantage your use of the Service.

When featuring content we do not expose account information, email addresses, or raw prompts that could identify you; where such information — including author credit — needs to be shown, we ask for your consent first.

8. Prohibited Uses

You must not use the Service to:

• Create deepfakes or misuse a real person's likeness, voice, or personal data to deceive or impersonate.
• Infringe others' copyright, trademark, or other intellectual property.
• Create or distribute child sexual abuse material, non-consensual intimate imagery, or other unlawful, obscene, hateful, or violent content prohibited by law.
• Spread disinformation or defraud others.
• Disrupt the Service, abuse it via automated means, or reverse-engineer or circumvent our systems or models.

We may remove or block reported/violating content and restrict accounts without prior notice. Report unlawful content to support@designpresso.ai.

9. Changes, Suspension, and Termination

We may modify or suspend the Service for maintenance, provider issues, or other reasonable cause, with notice where practicable. You may terminate anytime by deleting your account in Settings; we may restrict or terminate accounts that violate these Terms or law.

10. Disclaimers and Liability

• AI outputs are generated automatically and may be inaccurate, inappropriate, or infringe third-party rights. You are responsible for checking legality and accuracy before use; we do not warrant outputs.
• We are not liable for losses caused by events beyond our reasonable control, including failures of third-party AI providers, payment processors, or infrastructure.
• Nothing here limits liability that cannot be limited under applicable law.

11. Governing Law

These Terms are governed by the laws of the Republic of Korea, and disputes are subject to the courts having jurisdiction under applicable law. Effective July 4, 2026; Section 7 (Use of Data for Research and Promotion) was added and took effect on August 18, 2026; if you do not agree, you may terminate your account or object to research and promotional use at any time under that Section.
